Publishing information on remote education provision – new legal duty

The previous expectation for schools to publish information about their remote education provision on their website, has now become a legal duty. The Education (Coronavirus, Remote Education Information) (England) (Amendment) Regulations 2021 came into force on 12 February 2021 and updates the existing legislative requirements for schools to publish details about their in-school curriculum. There is now also a requirement for schools to publish details of their remote education provision. We use the school websites for our remote learning provision through the virtual learning environment (VLE) built into it.  Pupils can access this by clicking on the Pupil Login button in the top left hand corner.  Click below to see how it works.

Our academies will provide remote education if:

  • Individuals or groups of pupils need to self-isolate, but the rest of the school is still open; or
  • There are local or national restrictions that mean most pupils need to stay at home.

We will also use the VLE regularly to set homework and ongoing learning throughout the year.

How does the School Spider VLE work?

School Spider's pupil area means they can pick up/download home working, complete it, upload for marking and engage in online class discussions.  

What sort of work will be set?

The work will be uploaded by the class teacher and will continue the learning that either was due to be taught in class (if the bubble is self-isolating or there is a partial school closure due to a national lockdown) or reflects the work being taught in class (for individual pupils self-isolating).  

This will be a mixture of live lessons, teacher produced resources and activities as well as commercially available online resources such as Oak National Academy, Purple Mash and Times Table Rockstars.  Whichever activity or resource best fits the learning will be chosen rather than just using one resource.

The activities set will be downloadable in formats that will be accessible to all (for example text may be put direct onto the activity page on school spider or converted to PDF rather than in a word document which not every device will be able to read). 

There will also be a range of activities to 'go off and do' to ensure that children are not having to sit in front of the screen all the time.  

We do not expect children to have to print anything off to be marked.  They can type straight into school spider, take a photo or save a document and upload it.  They will then get feedback on their work from their teacher.  

How can we help if your child does not have a digital device or internet access at home?

If your child does not have access to the internet or technology at home then please get in contact with us as there are several ways we can support to make sure that they get access to all the learning that they are entitled to including;

  • Loan of a school device (this may be a Chromebook or tablet and will require parents to sign a device loan agreement)
  • Provision of SIM cards or dongles to provide internet access
  • Printed work packs for your child to work through

How will we support you in making sure that your child engages with their remote learning?

Schools will check your child’s engagement in a number of ways including, monitoring who is attending live lessons, completed work that has been submitted/ uploaded and monitoring how your child is doing when accessing digital resources such as Times Table Rockstars.

If monitoring shows that your child is struggling to engage with their remote learning we will call you to find the best way to support your child.

We ask for your support with this by discussing your child’s remote learning with them and by helping them to set a good working routine when learning at home (the remote learning overview timetables – available to download below - should support you with this).

How will we assess your child’s work and progress?

Children will be assessed continually through a variety of strategies including; interactions with the teacher during live lessons, reviewing their learning that has been submitted and monitoring how your child has done on retrieval task and online quizzes. The teacher will use these strategies to plan further learning or provide your child with any support they may need.

Your child will receive feedback from the teacher so they know how they are doing and how they can improve. Feedback will be in a variety of forms including; whole class feedback, individual feedback on work, calls to your child to discuss their learning or work that is marked automatically by digital platforms.

All schools have an obligation to respond to the Government’s advice on the Coronavirus and the development of the NHS ‘Track and Trace’ scheme is a key part of the Government’s plan to manage Coronavirus

As our schools have re-opened it has been our priority to ensure that the wellbeing and health and safety of our children, staff and their families is at the heart of our planning in order to ensure that our schools are safe places to return

Our responsibility extends beyond the school gates and we have a duty to respond to the government’s guidance.  We hold a lot of data and it may be necessary for us to share this data, when request to do so, with the Public Health NHS (National Health Service) Trace and Trace Workers.

We expect that we will be asked to provide details, including contact details, of any cases of Coronavirus (or a suspected case) that may arise within any of our schools within The Rose Learning Trust.  We have an obligation to share this, and any other health data, as part of our Public Duty as set out below.

We will endeavour to contact any and all individuals directly do that we can manage the information and sharing of their data.  However, in some cases we may be required to provide this to the new Public Health HS Track and Trace system

NHS Test and Trace – The Law

The law on protecting personally identifiable information, known as the General Data Protection Regulation (GDPR), allows Public Health England to use the personal information collected by NHS Test and Trace.

The section of the GDPR that applies is:

Article 6(1)(e) ‘processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller’

As information about health is a special category of personal information, a further section of the GDPR applies:

Article 9(2)(i) ‘processing is necessary for reasons of public interest in the area of public health, such as protecting against serious cross-border threats to health or ensuring high standards of quality and safety of healthcare’

Public Health England also has special permission from the Secretary of State for Health and Social Care to use personally identifiable information without people’s consent where this is in the public interest. This is known as ‘Section 251’ approval and includes the use of the information collected by NHS Test and Trace to help protect the public from coronavirus. The part of the law that applies here is Section 251 of the National Health Service Act 2006 and the associated Health Service (Control of Patient Information) Regulations 2002.

Test and Trace

Schools are in a very different situation.  The tracing process of ‘Test and Trace’ is made more difficult as schools are public authorities.  They have a legal duty to protect and promote the welfare of pupils and a duty of care to staff.  It is hoped that additional government guidance will be provided for schools.

As a private individual, compliance with the scheme is optional, you cannot at the present time be forced to provide details.  As a school it is more complicated.

If a person in a school has Covid or symptoms they will be sent home as will other people in school who have had contact and who may be at risk.

In school it would be most unusual for any one person to know the details of everyone else who may be affected.  It is only the school that will have that data.  We would notify individuals about a risk, and in many instances that will be sufficient

However, the Department of Education Guidance goes onto say:

‘As part of the national test and trace programme, if other cases are detected within the child or young person’s cohort or in the wider education or childcare settings, Public Health England’s local Health Protection Teams will conduct a rapid investigation and will advise the schools and other settings on the most appropriate action to take’

So in this situation is it not a matter of giving consent to share the data, there is a Public Duty to do so  As a Trust we will co-operate with such requests and we are under an obligation to share data.

At no point we will share data without a sound legal basis, but please be aware that we will share data where necessary.

 The law does not oblige the Trust/school to comply with all requests.  If the Trust/school does not intend to comply with the request, then the individual will be notified of the reasons why in writing.

Privacy Policy Changes

Although most changes are likely to be minor, The Rose Learning Trust may change its Privacy Policy from time to time at The Rose Learning Trust’s sole discretion.


As you know, we are all facing extraordinary challenges at this time and the situation is placing pressure on all parts of society.
